TERMS AND CONDITIONS |
TOUR CONDITIONS AND PRICING:
This tour requires a minimum number of travelers to operate
and O’ SOLE MIO TOUR reserves the right to cancel up to
75 days before departure date with no liability. A € 500
per person deposit is required to hold a reservation. Final
payment must be received 90 days before departure date or space
is released and the cancellation penalty applied.
FINAL
PAYMENT:
Final Payment is due at O’ SOLE MIO TOUR 90 days prior
to the first day of travel. If payment is not received at the
due date, reservations will be subject to cancellation and forfeiture
of deposit. For enrollments made after this time, the entire
sum must be paid at the time of reservation.
LATE
BOOKINGS:
There will be a € 100 late fee for bookings less than 90
days prior to departure.
TRAVEL
INSURANCE:
We strongly recommend that the passenger obtain insurance covering
full medical expenses, personal accident, accidental loss, public
liability and damage to property. We do not accept any liability
for death or injury arising as a result of this tour.
REFUNDS:
If you cancel a full refund minus a € 200 per person handling
fee will be provided if written cancellation is received from
date of booking to 90 days prior to departure. No refunds will
be made for cancellations received after 90 days prior to departure.
There will be no refunds for any unused portion of tour.
CHANGES: For any name changes (name
of participant) made after final payment, a € 50 per person
fee applies.
Notice: All changes, cancellations, refunds
or requests must be made in writing.
TRANSFERS:
Where transfers are included, there is one scheduled group transfer
for arrival and departure at a designated time an place. It
is the responsibility of the tour participant to be at the transfer
point at the designated time.
TOUR
PRICES:
All prices are per person and based upon double occupancy. Single
and triple reservations are available with a price adjustment.
TRAVEL
DOCUMENTS:
It is the responsibility of each tour participant to obtain
and carry a valid passport, visa(s), and any other documents
required by applicable government regulations. Non US residents
may require special travel documents. Check with your local
embassy or consulate.
RESPONSIBILITY:
- O’SOLE MIO TOUR does not own or operate any of the suppliers
of services or accommodations for your trip. As a result, it
is not responsible for any negligent or willful act or failure
to act any such supplier or of any third party over whom. O’
SOLE MIO TOUR has no control.
-O’SOLE MIO TOUR acts only in the capacity of an
agent of all land transportation, sightseeing, tour operators
and hotels which provide services included in the specified
tour. The individual tour participant agrees that O’SOLE
MIO TOUR shall not be liable for any injury, damage, loss, accident,
delay, or irregularity, liability or expense to person or property
due to any act of default of hotel, land transportation carrier,
restaurant supplier or other contractor rendering or providing
services.
-O’SOLE MIO TOUR shall not be responsible for any
expense or liability resulting from labor disputes, war, acts
of terrorism, government restraints, weather conditions, sickness,
pilferage or any other cause beyond its control.
-O’SOLE MIO TOUR reserves the right to accept,
or to retain or refuse any person as a participant of any tour
or to cancel any program of a tour if circumstances so demand.
-O’SOLE MIO TOUR reserves the right to cancel any
tour prior to departure for any reason (including insufficient
number of participants), or substitute services or hotels of
equal quality without prior notification. The tour departure
can only be guaranteed only after the groups final payment has
been received. Participants are consequently encouraged to purchase
airline tickets no sooner than 75 days before the tour begins
to avoid airline cancellation penalties if the tour is cancelled.

AGREEMENT RELEASE AND ACKNOWLEDGEMENT OF RISK |
Waiver and Release of Liability
In
consideration of O’SOLE MIO TOUR furnishing services to
enable me to participate in one of its programs, I agree as
follows:
I fully understand and acknowledge that culinary and travel
activities have:
(a) inherent risks, dangers and
hazards and such exists in my participation in O’ SOLE
MIO TOUR sponsored activities;
(b) my participation in such activities
may result in injury or illness;
(c) these risks and dangers may
be caused by the negligence of the owners, employees, officers
or agents of O’SOLE MIO TOUR , the negligence of the participants,
the negligence of others, accidents, breaches of contract, the
forces of nature or other causes;
(d) by my participation in these
activities, I hereby assume all risks and dangers and all responsibility
for any losses and/or damages, whether caused in whole or in
part by the negligence or other conduct of the owners, agents,
officers, or employees of O’SOLE MIO TOUR, or by any other
person.
I, on behalf of myself, my personal representatives and my heirs
hereby voluntarily agree to release, waive, discharge, hold
harmless, defend and indemnify O’SOLE MIO TOUR and its
agents, officers and employees from any and all claims, actions
or losses for bodily injury, property damage, wrongful death,
loss of services or otherwise which may arise out of my participation
in O’SOLE MIO TOUR activities.
I understand that O’SOLE MIO TOUR reserves the right to
take photographic or film records of any of its programs, and
hereby agree that O’SOLE MIO TOUR may use any such photographic
or film records for promotional and/or commercial purposes.

For any potential controversy the competent place of jurisdiction
will be ROME.
